Biometric Data Policy

This Biometric Data Policy explains how Ovation collects, uses, retains, and destroys biometric information in connection with our AI face-swap features. We are committed to transparency and compliance with applicable biometric privacy laws.

1. What Biometric Data We Collect

When you use our AI face-swap feature, Ovation (and its processing partners) extract face geometry data — mathematical representations of facial landmarks — from photos you upload. This data is used solely to composite your likeness into a chosen scene template. No other biometric identifiers (e.g., fingerprints, voiceprints, retina scans) are collected by Ovation.

2. Purpose

Face geometry data is extracted and used solely to create the requested celebratory face-swap image you have consented to generate. We do not use biometric data for identification, authentication, advertising, analytics, or any purpose beyond fulfilling the specific face-swap request.

3. Retention Schedule

Source photos uploaded for face-swap processing and any derived face geometry data are destroyed within 24 hours of processing completion. Output images (the finished face-swap result) are stored on your board until you delete the board or request deletion. Ovation does not retain biometric data beyond this schedule under any circumstances.

4. No Sale or Disclosure

Ovation does not:

  • Sell, lease, trade, or otherwise profit from biometric data.
  • Disclose biometric data to third parties, except as strictly necessary to complete the face-swap processing (see Section 5 below).
  • Use biometric data for AI model training or dataset purposes.
  • Share biometric data with affiliates, advertisers, or data brokers.

5. Third-Party Processors

To fulfill face-swap requests, Ovation transmits source photos to the following sub-processors:

  • Akool (akool.com) — AI face-swap rendering service.
  • Segmind (segmind.com) — AI image processing service.

Both Akool and Segmind are contractually bound to delete biometric data and source photos within 24 hours of processing completion, and are prohibited from using such data for any other purpose.

6. Illinois BIPA Compliance

Ovation complies with the Illinois Biometric Information Privacy Act (BIPA), 740 ILCS 14. Illinois residents have the following rights with respect to their biometric information:

  • Right to know what biometric data is being collected and for what purpose — provided in this policy and at the point of collection.
  • Right to know how long biometric data will be retained — destroyed within 24 hours of processing completion.
  • Right to request early destruction of your biometric data before the retention period ends. To exercise this right, contact us at privacy@ovationchain.com.

Ovation obtains written informed consent before collecting biometric data. This consent is obtained through the in-product consent dialog prior to any face-swap processing and is logged with a timestamp, IP address, and consent text for compliance purposes.

8. Changes to This Policy

We will provide at least 30 days' notice before any material changes to this Biometric Data Policy take effect. Notice will be provided via email to registered users and a prominent notice on our website. Continued use of the face-swap features after the effective date constitutes acceptance of the updated policy.
